Triple T Internet Co., Ltd. (“the Company”), as owner and operator of “www.telehealththai.com” website including “Chat with Doctor” (“คุยกับหมอ”) mobile application, realizes the importance of Data Protection measure for each user (“user”) using the Company’s service. The Company has provided Data Protection measure to protect every user who visit the Company’s website, use the Company’s mobile application or request any other online service from the Company’s platform. The measure controls how the Company handles user’s Personal Data including how to store, use, disclose, delete, etc. (inclusively called as “process”) and right of user. In order for the user to be informed of the user data protection measure, the Company hereby announces our User Privacy Policy as listed below :-

1. Personal Data which may be processed by the company
Personal Data means any data pertaining to a person, which may enable the identification of such person, whether direct or indirect, but does not include data of dead person in particular, as follows
- Personally Identifiable Information such as Name prefix, Name, Surname, Photograph, Gender, Date of Birth, Part of ID number (the last 4 digit)
- Contact information such as mailing address, telephone or mobile number, email address
- Service Data such as basic personal health advice from healthcare professional, chat dialogues between user and healthcare professional, image file
- Marketing activity participation information such as registration information for activities with the Company (No such activity since the beginning of the service)
- Statistical data such as number of registered users or active users (for mobile application), number of visitors (for website)
- IP address (of visitors, users)
- Log of contact information such as telephone number calling to the Company’s contact center including IP address, MAC address or cookies in case of online contact
- Basic health information such as chat dialogue and healthcare professionals’ advice information including announcement information
- Medication history of drug allergy information (No such activity since the beginning of the service)
- Recorded conversations while during the preliminary inquiry or consultation (if any in the future as the Application provides only Chat platform)
- User’s feedback information (if any)

2. Source where the Company obtains Personal Data
2.1 Directly obtained from user via
2.1.1 Sign up information
2.1.2 Other sources such as via email address, telephone call or by post
2.2 Indirectly sources such as from social media, from other websites or applications which user has already granted consent to share his personal information. (No such activity since the beginning of the service)

3. Objective and legal base in Processing of Personal Data
The Company will process user Personal Data based on the following bases

3.2 Legitimate Interest basis
3.3 Legal Obligation basis
3.4 User Consent
3.5 For statistical purpose with appropriate measures to protect user’s personal right

4. Personal Data collection, usage, disclosure
Once the Company obtains user’s Personal Data, the Company will do the following tasks to the data
4.1 Collect and Store
4.1.1 The company will collect and store user’s Personal Data as much as necessary for service or marketing purpose including any lawfully objective or purpose
4.1.2 The Company will always ask for user consent before data collection except or in case of
(1) For study, research, statistical purpose
(2) Vital interest
(3) For compliance with contract in force or pre-contract period
(4) For public interest or any lawfully purpose
(5) Under legal and/or regulation enforcement
4.1.3 The Company will not store any sensitive data, for example, race, ethnicity, political opinion, creed, religion, philosophy, etc. except in case of
(1) With explicit user consent
(2) Vital interest in case the Company cannot make any contact with user
(3) Under Personal Data Protection Act enforcement
4.2 Usage of Personal Data
The Company will use Personal Data for the purpose of the service, improving service quality, management, marketing or any other lawfully purposes.
4.3 Disclosure of Personal Data
The Company may disclose user’s Personal Data as much as necessary and may send the data to the following person or entity.
(1) Data Processor or Cloud Computing operator
(2) Regulator, Government agency, for example, National Broadcasting and Telecommunications Commission (NBTC), Securities and Exchange Commission (SET), Royal Thai Police or any person to whom the Company has to disclose data due to law or regulation enforcement, or under court’s jurisdiction.
(3) For the establishment of claims by the Company under the contract or under the law or for any legal claim.

5. Automatic data processing
Under explicit user’s consent, the Company may automatically process user’s Personal Data or collecting such Personal Data for marketing objective. User may request the Company to withdraw his own consent via contact channel detailed in clause 10.

6. Right of user on his own Personal Data
User has the following right on his own Personal Data
6.1 Right of access
6.2 Right to data portability
6.3 Right to object
6.4 Right to be forgotten
6.5 Right to restrict processing
6.6 Right to rectification
6.7 Right to withdraw consent
The Company will process within reasonable time frame and not exceed duration stipulated by laws for any user’s request mentioned above. The Company will abide by related laws or regulations in processing any user’s request on his own Personal Data. In case user requests the Company to delete, de-identify or suspend the usage of his own Personal Data, the user realizes that such request may affect the service to the user. The Company reserves the right to charge user for any request above. User may request the Company to stop the usage of his own Personal Data in case the data usage is exceed objective or without user consent or not comply to the Company’s data protection measure, then the Company has to response to such user request but such request shall not affect the Company’s service or out of the Company’s ability to response to such request.

7. Duration and storage of Personal Data
The Company will store user’s Personal Data in the following ways
7.1 In Soft copy form
7.2 Store in Computer or local hardware such as disk or tape or store in high standard commercial Cloud service
7.3 The Company will store user’s Personal Data as much as necessary for achieving the following objectives
7.3.1 Only for duration when such user is still in the service or in legal relation with company
7.3.2 In case the service is terminated, the Company will store Personal Data for 10 years starting from the termination date except in case required by law to extend such duration or for the establishment of claims of the Company under the contract or under the law including raising any lawfully claim.
7.3.3 After the storage duration expires, the Company will delete such personal information or make it into irreversible de-identification format

8. Personal Data Protection Measure
The Company will handle all data in electronic format with appropriate process and standard to protect data from any loss, leakage, un-authorized access including unauthorized disclosure.

9. Change to Privacy Policy
The Company will regularly review the policy to comply with related laws and regulations. In case there is any change or update to the Company’s Privacy Policy, the Company will update the policy published in www.telehealththai.com and “Chat with Doctor” (“คุยกับหมอ”) application as soon as possible.

This Privacy Policy is written in both English and Thai version. In the event of conflict or it is not clear between the two version, Thai version of this Privacy Policy shall govern.
